Our company had a problem with 3 container with the consignee has gone missing when it arrives at Hamburg.One thing is that our goods are not yet fully paid by them but the worst thing is that the shipping company are asking us to pay the storage warehouse and container demurrage and for 23 days it cost us more than 5000 euros.

Can anybody inform me about the legal procedure for this?The shipment is FOB terms and FREIGHT COLLECT that means the consignee is originally responsible for the shipping cost.But as we want to re-sell the goods to others or bring it back to china, they insist that we pay first the penalties and not only the O/F before they release the cargoes to us.We, as the shipper is the sole responsible for loss? (Goods being not paid, have to pay O/F from china-hamburg and hamburg-china, and also pay these storage and container penalty even w/o considering to give us any single cents discount?)Only for the penalty, they want us to pay euro 5033.00 (21-23 days)
